‘Gandhis in court’: How Subramaniyam Swamy’s Dream Will Not Let Rahul Gandhi Become The Next PM

The Judge read out “Do you Plead guilty”? and the Congress  President  Rahul Gandhi replied” I do not Plead guilty”. These are not dialogues  from any movie but are the real dialogues which were exchanged in the local court of Bhiwandi in Maharashtra. It seems like he himself invites troubles. What charges against Rahul Gandhi made him appear before the court? If he walks out of this then what are the other charges which will fade his dream of becoming the next Prime Minister? On what bases does Subramaniyam Swamy assure that Rahul Gandhi will not be the next Prime Minister even if Congress wins the election of 2019?Would he be the first President in Congress to be banned from the contest of Prime Minister? Is it a revengeful act from the Subramaniyam Swamy? As we all know as far as the Gandhis are concerned Swamy is a one-man army– a Terminator. Answers are there in  history.

Well, Rahul Gandhi’s speeches and eerie statements sure make for a laugh riot but this time he has dug a grave for himself. Congress president Rahul Gandhi has reached Mumbai and appeared before Bhiwandi court in a defamation case filed by an RSS worker against him. He has been charged under section 499 and 500 of the Indian Penal Code.

Is Subramaniyam Swamy Taking revenge for 1975 year after year?

Swamy is never shy of placing himself firmly in a historical context. If you remember the 12th of June 1975 when Indira Gandhi got banned for six years. The court ordered her stripped of her parliamentary seat and banned her from running for any office for six years as was found guilty of dishonest election practices, excessive election expenditure, and of using government machinery and officials for party purposes. Just after 25th June 1975 Indira Gandhi feared that things were getting out of her control and declared an Emergency, during the emergency fundamental rights were suspended and any person who opposed the government was either detained or arrested.

The Indian Constitution that gave extraordinary powers to Indira Gandhi was misused. Subramaniyam Swamy was one of them who were opposing the emergency. Subramaniyam Swamy had said at that time that Congress sent people to jail outside the rule of law and now it’s Gandh’s turn. In 2012, Subramaniyam Swamy filed a complaint in a trial court alleging that YIL, which is a company with 83.3% shares with the Congress leader Sonia Gandhi and Rahul Gandhi had taken over AJL to gain profit. The total money devoured by the Congress leaders in this particular scam is estimated to be no less than Rs 2,000 crores by means of fraudulent property papers. Now this Bhiwandi case of 2014. Swamy said Rahul Gandhi will not be able to contest 2019 general election if found guilty because he will either be in jail or will be banned for election.

What is Bhiwandi Case all about?

Once before in 2014 Rahul Gandhi blamed Rashtriya Swayamsevak Sangh(RSS) for assassination of Mahatma Gandhi. He said “RSS ke logon ne Gandhi Ji ko goli mari aur ye log Gandhi Ji ki baat karte hain.” Rajesh kunte an RSS worker has filed the case after Rahul Gandhi refused to apologize for which he had to make an appearance in court.

All you need to know about punishment prescribed under section 499 and 500:

Section 499 states,

“Whoever, by words either spoken or intended to be read, or by signs or by visible representations, makes or publishes any imputation concerning any person intending to harm, or knowing or having reason to believe that such imputation will harm, the reputation of such person, is said, except in the cases hereinafter expected, to defame that person. ”

Again, section 500, which also talks about defamation states,

“Whoever defames another shall be punished with simple imprisonment for a term which may extend to two years, or with fine, or with both.”

So if above charges applied on Rahul Gandhi are proven right then it is going to be the toughest time ever for him. Though Rahul Gandhi is saying it makes no difference to him but in reality he is unable to estimate the weightage of its after effects. It can make the biggest of the differences if he is not able to fight for the upcoming Loksabha Elections in 2019. Well,we hope Rahul Gandhi will take this blunder as a great learning and will avoid laying such false allegations and baseless speeches in future. Congress and Rahul Gandhi are in great trouble but Dr Subramaniyam Swamy has just got closer to his most ardent dream  of ‘Gandhis in court’.
